Will

The Last Will and Testament of Benjamin Notley Mitchell September
1784

In the name of God Amen. I, Benjamin Notley Mitchell, of prince
Georges County in the State of Maryland, do make this my last will
and testament.

Item: I give and bequeath unto my well beloved wife Elizabeth
Mitchell one hundred and forty one Acres of Land being part of a
tract called "Thomas and Sarah" lying at the lower end where Richard
Mitchell now lives for the Term of her own life and after her decease
the aforesaid parcel of land to belong to my grandson Matthias
Mitchell & his Heirs for ever.

Item: I give and bequeath unto my aforesaid wife five negroes, to
wit, Sue, Rachel, Nace, Davey & Hany & their increase to her and her
heirs for ever. Also I give and bequeath to my aforesaid wife a Bay
Mare six years old and her first colt two years old next spring and a
bay horse called Selim.

Item: I give and bequeath to my grandson Thomas Mitchell Mudd the
remaining part of the tract of land called thomas and Sarah also a
tract of land called "Mitchells Strife" containing thirty three acres
more or less to him and his heirs for ever.

Item: I give and bequeath to my grandson Bennett Mudd one negro girl
named Look & her increase to him and his Heirs forever.

Item: I give and bequeath to my grandson Notley Mitchell one negro
girl named Charity & her increase to him & his Heirs forever.

Item: I give and bequeath to my Grand Daughter Elizabeth Mudd,
daughter of Thomas Mudd, four negroes, to wit, one woman named Lett,
one girl named Sall, one boy named Phill and one boy named Harry and
their increase to her and heirs forever but if in case she should die
without Heir the aforesaid negroes and their increase to be equally
divided between my two Grand Children Elizabeth Mudd and Tabitha Mud
Daughters of Thomas Mudd & their heirs forever.

Item: I give and bequeath the remaining part of my Estate that is
not mentioned in manner and form following Vize: one third part to my
aforesaid wife and one third part to Thomas Mudd children and one
third to Richard Mitchell's children in an equal division to them and
their heirs forever.

Lastly, I consitiute and appoint my wife Elizabeth Mitchell to be
Executix and Thomas Mudd to be Executor of this my last will and
testament. In witness whereof I have hereunto afixed my hand and
seal this thirteenth day of September in the year of our Lord one
thousand seven hundred and eighty four.

Signed, sealed and acknowledged this to be my last will and testament
in the presence of us -

Prince Georges County, October 23rd, 1784.
Then came Francis Jenkins and Thomas Hagoan, the two subscribing
witnesses to the within last will and testament of Benjamin Notley
Mitchell, late of Prince Georges County, deceased and severally made
Oath on the Holy Evangels of Almighty God that they did see the
testator therein named sign and seal this will and that they heard
him publish pronounce and declare the same to be his last will and
testament, that at the same time of his so doing, he was to the best
of their apprehensions of sound and disposing mind memory and
understanding and that they together with Ignatius Mudd, the other
subscribing witness, respectively subscribed their names as witnesses
to this will in the presence and at the request of the testator and
in the presence of each other.
